1. Introduction

This End User License Agreement (“EULA”) is a legally binding agreement between you (“User”, “you”, or “your”) and Alpas Technology Pvt. Ltd. (“Alpas Technology”, “Nagarik Alert”, “we”, “our”, or “us”) governing your access to and use of the Nagarik Alert mobile application, website, dashboards, QR-based services, public report pages, and related services (collectively, the “Platform”).

By downloading, accessing, registering for, or using the Platform, you acknowledge that you have read, understood, and agreed to be bound by this EULA and all related policies, including the Privacy Policy and Community Guidelines.

If you do not agree to this EULA, you must discontinue use of the Platform.

2. Platform Description

Nagarik Alert is a citizen engagement, reporting, QR-based public interaction, and organization coordination platform that enables users to submit alerts, reports, QR-linked information, and public-interest information to participating organizations and authorized entities.

The Platform may support:

Public-interest reporting
Media uploads
Anonymous reporting
QR-based public interaction features
Public report visibility
Organization coordination
Dashboard and operational workflows
Public report sharing and visibility

The Platform is operated by Alpas Technology Pvt. Ltd., located in Pulchowk, Lalitpur, Nepal.

3. Eligibility

By using the Platform, you represent and warrant that:

You are at least sixteen (16) years of age
You have the legal authority to accept this EULA
You will comply with applicable laws and regulations
Information submitted by you is accurate to the best of your knowledge

Alpas Technology reserves the right to restrict or terminate access where eligibility requirements are not met.

4. License Grant

Subject to compliance with this EULA, Alpas Technology grants you a limited, non-exclusive, non-transferable, revocable license to:

Download and use the Nagarik Alert application
Access Platform services
Submit reports and information
Use QR-based features
Access publicly available features
Interact with participating organizations through the Platform

This license is granted solely for lawful personal or authorized organizational use.

No ownership rights in the Platform are transferred to users.

5. User Accounts and Access

Certain features require account registration and OTP-based verification.

Users are responsible for:

Maintaining account security
Protecting device access
Preventing unauthorized account usage
Ensuring submitted information remains accurate where applicable

Users are responsible for all activities conducted through their accounts.

Alpas Technology reserves the right to suspend, restrict, or terminate accounts where necessary for:

Security
Abuse prevention
Operational integrity
Policy enforcement
Legal compliance

6. User Content and QR-Linked Information

Users may submit:

Text reports
Images/photos
Videos
Audio files
GPS/location information
QR-linked public information
Related public-interest content

Users retain ownership of their submitted content.

However, by submitting content or enabling QR-based features through the Platform, users grant Alpas Technology and Nagarik Alert a non-exclusive, worldwide, royalty-free, operational license to:

Store
Process
Display
Publish
Moderate
Reproduce
Distribute
Share
Analyze
Use submitted content or QR-linked information

for purposes related to:

Platform operations
Public-interest reporting
QR-based communication or coordination
Organization coordination
Moderation and safety
Analytics
Platform improvement
Operational and administrative functions

Participating organizations may receive operational access and usage rights to reports and submitted information for coordination and operational purposes.

7. Public Visibility and User Awareness

Users acknowledge and understand that:

Certain reports, QR-linked pages, and uploaded media may become publicly visible
Public reports or QR-linked pages may be accessible through websites, dashboards, public URLs, search engines, or QR scans
Public reports or QR-linked information may be shared externally by organizations or third parties
Publicly visible content may remain accessible outside the control of Alpas Technology

Users should avoid uploading or sharing:

Sensitive personal information
Confidential information
Government-issued identity information
Exact residential addresses
Personally harmful content
Information that may create privacy or safety risks

Users are solely responsible for the information they choose to make publicly accessible.

8. Anonymous Reporting

The Platform may provide anonymous reporting functionality for selected categories or operational purposes.

Anonymous reporting may:

Hide identity from public users or participating organizations where applicable
Retain certain technical, account-linked, operational, or security-related information internally

Anonymous reporting does not guarantee absolute anonymity under all circumstances.

Internal information retention may occur for:

Security
Abuse prevention
Fraud detection
Legal compliance
Operational integrity
Investigation purposes

9. QR-Based Features

The Platform may provide QR-based identification, communication, coordination, or public interaction features.

Users are solely responsible for:

Information associated with QR-linked profiles
Ensuring submitted information is lawful and authorized
Managing QR visibility and activation status
Disabling or deleting QR-linked profiles where necessary

Users acknowledge that QR-linked information may become publicly accessible to individuals who scan or access associated QR codes.

QR functionality is provided as a voluntary public communication and coordination feature.

Nagarik Alert does not independently guarantee or certify:

Ownership claims
Identity authenticity
Legality or accuracy of submitted QR-linked information

Alpas Technology reserves the right to:

Suspend or disable QR-linked profiles
Restrict QR functionality
Remove QR-linked content
Investigate misuse, harassment, spam, impersonation, or fraudulent activity

10. Prohibited Conduct

Users shall not use the Platform to:

Submit knowingly false or misleading reports
Upload unlawful or unauthorized content
Upload copyrighted material without authorization
Harass, threaten, abuse, or intimidate others
Upload voyeuristic, stalking, or privacy-violating material
Impersonate individuals or organizations
Misuse QR-linked features or public contact functionality
Conduct unlawful surveillance or recording
Upload malicious software or harmful files
Abuse APIs or operational infrastructure
Circumvent security or operational protections
Use the Platform for fraudulent, unlawful, or harmful activities

Users are responsible for ensuring they have the lawful right and necessary permissions to upload or share submitted content and information.

11. Sensitive Content and Moderation

Certain categories of reports, media, or QR-linked information may be:

Restricted
Moderated
Hidden
Reviewed
Removed
Prevented from public visibility

for reasons including:

Safety
Privacy
Public-interest protection
Legal compliance
Operational requirements
Platform integrity

Sensitive categories may include:

Minors or children
Graphic injuries
Dead bodies
Sexual harassment
Domestic abuse
Police or legal matters
Sensitive medical situations

Alpas Technology reserves the right, but not the obligation, to:

Moderate content
Remove content
Restrict visibility
Suspend users
Investigate misuse
Enforce policies
Cooperate with lawful investigations

12. Participating Organizations

Participating organizations may:

Access reports
Access media and related information
Access QR-linked information
Download or export information
Manage operational workflows
Share information where operationally or legally necessary

Participating organizations are independently responsible for their own handling, processing, sharing, retention, disclosure, and use of information accessed through the Platform.

Alpas Technology is not responsible for independent actions, decisions, disclosures, or downstream handling performed by participating organizations.

13. Emergency and Public-Safety Disclaimer

Nagarik Alert is not an emergency-response, law-enforcement, ambulance, disaster-response, ownership-verification, or guaranteed public-safety service.

Submission of reports or use of QR-based features does not guarantee:

Review
Response
Resolution
Intervention
Verification
Action by organizations or authorities

Users must contact official emergency services or relevant authorities directly in urgent or life-threatening situations.

The Platform may contain user-generated content involving public-interest matters, QR-linked information, and public interaction features, and Alpas Technology does not independently verify all reports, statements, media, allegations, ownership claims, identity claims, or submissions.

Alpas Technology does not guarantee:

Accuracy
Authenticity
Completeness
Reliability
Timeliness of submitted reports or QR-linked information

Users are solely responsible for their submissions and related consequences.

14. Intellectual Property

The Platform, including its software, design, branding, interface, systems, logos, QR systems, and related intellectual property, is owned by or licensed to Alpas Technology Pvt. Ltd.

Except for limited user-content rights described in this EULA, no rights are transferred to users.

Users may not:

Copy
Modify
Reverse engineer
Redistribute
Resell
Commercially exploit

the Platform without written authorization.

15. Third-Party Services

The Platform may utilize third-party services, including:

Hosting providers
Infrastructure providers
SMS/OTP providers
Cloud or storage providers
App store distribution platforms

Use of such services may be subject to separate third-party terms and policies.

Alpas Technology is not responsible for independent third-party systems or services beyond its reasonable control.

16. Suspension and Termination

Alpas Technology reserves the right to:

Suspend accounts
Restrict access
Remove reports, media, or QR-linked content
Disable features
Terminate Platform access

where reasonably necessary for:

Security
Abuse prevention
Legal compliance
Operational integrity
Policy enforcement
Public-interest protection

Users may discontinue use of the Platform at any time.

Certain records, reports, operational logs, or publicly visible information may continue to be retained as described in the Privacy Policy.

17. Limitation of Liability

To the maximum extent permitted by applicable law:

The Platform is provided on an “as is” and “as available” basis
Alpas Technology does not guarantee uninterrupted or error-free operation
Alpas Technology is not liable for user-generated content
Alpas Technology is not liable for independent actions of participating organizations
Alpas Technology is not liable for losses arising from:
- public visibility of reports or QR-linked information
- third-party sharing
- organizational actions
- inaccurate reports or information
- misuse of the Platform
- unauthorized access
- service interruptions
- delayed response or non-response
- misuse of QR-based features

Users use the Platform at their own risk.

18. Policy Updates

Alpas Technology may update or revise this EULA from time to time. The Platform may also introduce, modify, restrict, discontinue, or offer additional free or paid features, subscription plans, premium functionality, operational limitations, or commercial services in the future.

Users may be notified of significant updates where reasonably appropriate through:

Mobile application notices
Website notices
Email communications
Other available communication methods

Continued use of the Platform following updates constitutes acceptance of the updated EULA and related service changes.

19. Governing Law

This EULA shall be governed by and interpreted in accordance with the applicable laws of Nepal.

Any disputes arising from this EULA shall be subject to the appropriate jurisdiction within Nepal.
